Terms and Conditions
Pieter Daniel van der Westhuizen doing business as The Bush hereinafter referred to as The Bush
1. STANDARD TERMS AND CONDITIONS
Interpretations, in these standard terms and conditions of contract:
a. the headings to the clauses are for reference purposes only and shall not aid in the interpretation of the clauses to which they relate;
b. unless the context clearly indicates a contrary intention, words importing one gender includes the other two genders, the singular includes the plural and vice-versa, and natural persons include created entities (corporate or incorporate) and vice-versa;
c. “Pieter Daniel van der Westhuizen” means The Bush,
d. “the client” means the person / s named on the reservation form (whether it be a provisional or confirmed reservation form) and who contracts with The Bush on the terms and conditions hereunder. The client shall also include any agent who makes any booking of third party clients in respect of a reservation. Such agent, as well as the persons named on the provisional and the confirmed reservation form, shall be jointly and severally liable to The Bush for the performance of their obligations in terms of these standard trading conditions, as well as any contract / s made pursuant thereto;
e. “services” means the provision of self catering non serviced accommodation for the client at 3979 Erdvark Street Marloth Park.
2.
RESERVATIONS AND TERMS OF PAYMENT
All quotations given by The Bush in connection with the accommodation to a client shall be in writing and, unless otherwise agreed to in writing by a member of The Bush, shall be in the currency of South African Rand.
Such quotations shall be exclusive of South African value added tax.
Acceptance of any quotation by a client shall be in writing.
In order to secure a provisional reservation for accommodation required by a client, the client shall complete in writing, sign and dispatch to The Bush a provisional booking Reservation Form within 3 days of your verbal or written enquiry. Simultaneously, the client shall pay PD van der Westhuizen a non-refundable deposit of 50% (Fifty percent) of the quoted cost for the accommodation. In the event of the deposit not being paid aforesaid, the provisional booking shall lapse.
The balance of the fee plus R1000 refundable key deposit is due from the client at least 72 hours prior to arrival. In the event of non-payment of the balance of the fee in the prescribed period, the booking will be cancelled and the client will not be entitled to a refund of his deposit paid. Should the client wish to amend his reservation in any way the Bush may elect, in its sole discretion and without obligation, to do so.
The client shall make payments to The Bush only by way of direct transfer, direct deposit or forex transfer. The client shall provide The Bush forthwith, upon making any payment, with written proof thereof in the form of a deposit slip or remittance advice. The relevant reference will be the client surname for the booking and shall at all times be reflected on the proof of payment.
3. CANCELLATION PENALTIES AND REFUND POLICY
All cancellations take effect from the date they are received in writing by The Bush.
· Any time 15 days before arrival date - 75% of deposit paid is refundable
· Within 15 days prior to arrival date - NO refund.
4. DEPOSIT
R1000 key deposit is payable, any damage to the property or items at the lodge will be deducted from the deposit. The deposit or balance thereof will be refunded to the client within 7 days after departure.
5. DAMAGE TO PROPERTY
All damage to property belonging to the Bush will be for the clients account. Please report all breakage to The Bush before departure.
6. ARRANGEMENTS
To ensure that you enjoy your stay, please adhere to the arrangement listed below.
a. This lodge accommodates a maximum of 6 people. On written request a maximum of 2 additional children could be allowed at an additional cost of R100 per child per day. Own bedding must be provided for additional children.
b. Keys to the lodge are available from Field Security at 3883 Olifant Drive Marloth Park. Keys can be collected at anytime from 14:00 to 18:00 on the day of arrival, ask for the keys to 3979 Erdvark Street.
c. The keys to the house are for the backdoor. This door is located next to the parking area.
d. Please deactivate the alarm by pressing the grey button on remote. The alarm will beep twice when deactivated and once for activation. Always set the alarm when leaving the premises. Please do not set the alarm whilst in the house.
e. Please press *8 to deactivate the glass breaker alarm, after deactivating the alarm. Failure to do so will result in the alarm continuously going off. The alarm control panel is in room 2. Please contact Field Security at 013 792 4207 if there is a false alarm, this will prevent unnecessary call outs.
f. All rooms are locked; the keys to the rooms and outside doors are on the key holder next to the fridge. The TV and decoder are locked in the bathroom for security reasons and can be installed on the 2nd floor.
g. Please make sure that you close all windows before you leave at any stage. Baboons and monkeys will enter the house whenever possible and mess up your holiday.
h. Please take note that this is a self-catering not serviced unit; neither toilet paper nor towels are supplied.
i. DSTV is available; please bring your own DSTV card.
j. Always adhere to Marloth park local regulations, the most important being:
i. Do not gather wood, a lot of Tamboti trees are present in the immediate vicinity. Making fire with Tamboti wood will cause extreme illness and in certain instance even death. Wood is available at Gate no1 and at the local shops.
ii. Do not feed the animals
iii. Be careful when starting fires and please do not litter.
iv. Dangerous animals are present in Marloth Park. Please do not wander around between dusk and dawn.
k. The geyser is gas operated please follow the instructions posted at the geyser. The gas bottle is left inside the house to prevent theft. Please connect the bottle to the nozzle at the back door. Please disconnect the bottle and place it inside the house on day of departure.
l. The bedding is placed in the closets in every room. Please do not make your bed on the day of departure.
m. Please leave all the bedding on the beds and close all curtains on departure.
n. Please lock all rooms as well as the gate in the passage and hang the respective room keys on the key holder next to the fridge on day of departure.
o. Please return the main set of keys to Field Security on day of departure and remember to set the alarm.
p. Do not switch off the Fridge at any stage.
q. PLEASE DO NOT SMOKE INSIDE THE UNIT. Please throw away your cigarette buds in a bin, if you are smoking outside.
r. By legislation No pets under any circumstances are allowed in Marloth Park or at the Lodge. Animals entering Marloth Park are not allowed to leave the area, as this is part of the red zone. Pets entering this area illegally will be destroyed.

7. DISCLAIMER OF LIABILITY AND RESPONSIBILITY
Booking at The Bush is subject to the express condition that neither it nor any its officers, managers, members or employees shall be liable for any injury, damage, loss, accident, illness, defect, death, delay, cancellation, rescheduling or irregularity which may be occasioned by any act or omission of any company or person, including without limitation, any company or person engaged in providing lodging services.
Notwithstanding anything to the contrary contained in these standard terms and conditions of contract, The Bush shall under no circumstances whatever, be liable for any indirect or consequential loss / es, howsoever caused or suffered by the client.
8. RELEASE OF LIABILITY
Payment of the deposit and signing the The Bush Reservation Form constitute acceptance of the terms and conditions as recited in this document and release The Bush from all claims arising from occupying 3979 Erdvark Street Marloth Park. The Client consents to the risks inherent in occupying the lodge and warrants that he is aware of such risks and uses the facilities in connection with the accommodation with full knowledge and appreciation thereof and at his own risk. Kansellasiebeleid:
Meer as 30 Dae voor Aankoms: Ingeval 'n bespreking gekanselleer word, sal jou deposito teen huidige wisselkoerse terugbetaal word waar van toepassing, minus 'n bedrag wat 20% van die Totale Huurbedrag ewenaar. Dit sal binne sewe (7) werksdae geskied.
